Please read these Terms of Service carefully before using Civitas Protocol. By using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing and using Civitas Protocol ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, you must not use our Service.

2. Description of Service

Civitas Protocol provides a decentralized identity platform built on the XRP Ledger, enabling users to:

  • Create and manage digital identities
  • Store and verify credentials
  • Participate in decentralized governance
  • Access identity-based services
  • Interact with blockchain technology

3. User Responsibilities

As a user of our Service, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your wallet and private keys
  • Not use the Service for illegal or unauthorized purposes
  • Comply with all applicable laws and regulations
  • Not interfere with or disrupt the Service
  • Not attempt to gain unauthorized access to any portion of the Service
  • Be responsible for all activities under your account

4. Wallet and Private Key Management

You understand and agree that:

  • You are solely responsible for maintaining the security of your private keys
  • Lost private keys cannot be recovered by Civitas Protocol
  • Anyone with access to your private keys can access your assets
  • Civitas Protocol does not store or have access to your private keys
  • You must backup your private keys and recovery phrases securely

5. Prohibited Uses

You may not use our Service to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit malicious code or viruses
  • Engage in fraudulent or deceptive practices
  • Harass, abuse, or harm others
  • Attempt to manipulate or exploit the system
  • Create multiple accounts to abuse rewards or features

6. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by Civitas Protocol and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7. Privacy and Data Protection

Your use of our Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as detailed in our Privacy Policy.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability or fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or completeness of content
  • Uninterrupted or error-free operation
  • Security or safety of the Service

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CIVITAS PROTOCOL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or use
  • Business interruption
  • Personal injury or property damage
  • Unauthorized access to or alteration of your data
  • Any losses resulting from your use of the Service

10. Indemnification

You agree to defend, indemnify, and hold harmless Civitas Protocol, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your use or misuse of the Service
  • Your breach of any applicable laws or regulations

11. Modifications to Service

Civitas Protocol reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Civitas Protocol shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the British Virgin Islands, without regard to its conflict of law provisions. Any disputes, claims, or controversies arising from or relating to these Terms or the Service shall be resolved as follows:

  • First, through good faith negotiations between the parties for 30 days
  • If unresolved, through binding arbitration under ICC Arbitration Rules
  • Arbitration shall be conducted in English in Singapore
  • Each party shall bear their own costs unless arbitrator determines otherwise
  • CLASS ACTION LAWSUITS AND JURY TRIALS ARE HEREBY WAIVED
  • You waive any right to participate in class action or representative proceedings
  • Injunctive relief may be sought in courts of competent jurisdiction
  • For users in the EU, statutory consumer rights may apply as required by law

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the Service or by other means. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

15. Force Majeure

Civitas Protocol shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to:

  • Blockchain network failures, congestion, or consensus issues
  • Smart contract vulnerabilities or exploits
  • Cryptocurrency exchange outages or failures
  • Government actions, regulatory changes, or legal prohibitions
  • Cyber attacks, hacking attempts, or security breaches
  • Natural disasters, acts of God, or force majeure events
  • Internet service provider failures or infrastructure outages
  • Third-party service provider failures or discontinuations
  • Acts of war, terrorism, civil unrest, or political instability

16. AML and Sanctions Compliance

By using our Service, you represent and warrant that:

  • You are not located in, or a resident of, any sanctioned jurisdiction
  • You are not on any US, EU, UN, or other applicable sanctions lists
  • You will not use the Service for money laundering or terrorist financing
  • You will comply with all applicable AML and sanctions laws
  • You acknowledge that transactions may be monitored for compliance
  • We reserve the right to restrict access based on compliance requirements

17. Tax Obligations

You are solely responsible for determining and paying all applicable taxes arising from your use of the Service, including but not limited to income tax, capital gains tax, value-added tax, and any other taxes that may apply in your jurisdiction. Civitas Protocol does not provide tax advice and makes no representations regarding the tax treatment of any transactions.

18. Severability and Entire Agreement

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and Civitas Protocol.
